This Privacy Policy explains how HomeSpark, Inc. ("HomeSpark," "we," "us," or "our") collects, uses, shares, and protects information in relation to our mobile applications, websites, and all related services (collectively, the "Services"). In order for the HomeSpark Services to perform effectively, it is important that we have access to data and information about the environment in which our technology is operating.

This Policy is incorporated into and is subject to the HomeSpark Terms of Service. By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes.

1. How We Collect, Use, and Disclose Information

To provide the Services, we process information about you and your property. The information we collect, our purposes for using it, and the parties we may disclose it to are summarized in the table below.

Such as your interactions with our Sparky AI or app/website, which features you use, crash reports, and performance data. Inferences Drawn from Other Information
Such as our AI-generated analysis about your property, including potential maintenance needs, material types, or appliance models, derived from your User Content.	To provide you with personalized insights and recommendations; to improve the accuracy and capabilities of our AI; and to create aggregated market or industry trend reports.	Service Providers; Business Partners (with your consent); Research Partners (in de-identified or aggregated form).

For purposes of this Policy, ‘de-identified’ means information that cannot reasonably be used to infer information about, or otherwise be linked to, an identified or identifiable individual, and that is subject to technical and organizational safeguards to prevent re-identification.

Identifiers / Payment Information If you purchase Paid Features, we collect payment method details (such as credit card number, expiration date, and billing address) through our payment processor. We do not store full payment card information, but our payment processor may store it on our behalf. We use this information to process your payments, prevent fraud, and comply with applicable legal obligations. Transaction records are retained as required by law and for legitimate business purposes, including maintaining accurate financial and tax records.

2. How We Use Your Information in Detail

We use the information we collect for a variety of business purposes, which are essential to providing a valuable and safe service. These purposes include, but are not limited to, the following:

To Provide and Maintain the Services: To operate, deliver, and maintain all features of our Services, such as processing your Scans and providing AI Outputs.
To Improve, Personalize, and Develop Services: We use your information to understand how our Services are used, to personalize your experience, and to conduct research and development for new products and features. A core part of this is using your User Content and other data to train, refine, and improve our proprietary artificial intelligence models. This includes, but is not limited to, using your data to improve our ability to distinguish between appliances or cosmetic and structural issues, identify potential appliance malfunctions from visual cues, or develop new hazard detection algorithms.
To Communicate with You: To send you technical notices, updates, security alerts, and administrative messages. Subject to your settings and applicable law, we may also send you marketing communications about our products and services.
To Promote Safety, Security, and Integrity: To verify accounts, combat harmful conduct, prevent fraud and abuse, and maintain the integrity of our Services.
To Comply with Legal Obligations and Enforce our Rights: To comply with applicable laws and regulations, and to respond to valid legal requests, court orders, or government inquiries.

3. How We Share Your Information

We may share your information in the following circumstances:

With Your Consent or at Your Direction:
- We will share your personally identifiable information with our Business Partners only when you affirmatively opt-in to a specific program or offering that requires such sharing such as sharing a request to fix chat with a contractor or sharing your home scan image with social media. These Business Partners may include, but are not limited to, insurance carriers, licensed contractors, home warranty providers, or real estate professionals. This sharing does not include mobile contact information collected for text messaging purposes.
- We will share your personally identifiable information with other users only when you affirmatively opt-in to a specific program or offering that requires such sharing such as sharing HomeSpark home and its details or referring HomeSpark to another party.
With Service Providers and Sub-processors: We share information with third-party vendors and other service providers who perform services on our behalf, such as cloud hosting, data analytics, and customer support.
