NO GUARANTEE IS MADE THAT THE SERVICE WILL WARN AGAINST ALL POTENTIAL PROPERTY DAMAGE RISKS, STRUCTURAL ISSUES, OR FIRE HAZARDS.
THE SERVICE WILL NOT SHUT OFF POWER, CONTACT EMERGENCY SERVICES, OR PREVENT PROPERTY DAMAGE OR PERSONAL INJURY. THE AI OUTPUT MAY BE INACCURATE, INCOMPLETE, OR MISLEADING. RELIANCE ON THE SERVICE OR ITS OUTPUT IS AT YOUR SOLE RISK. HOMESPARK IS NOT A SUBSTITUTE FOR PROFESSIONAL HOME INSPECTIONS, LICENSED CONTRACTORS, OR A MONITORED SAFETY SYSTEM.

Welcome to HomeSpark! These Terms of Service ("Terms") are a legally binding agreement between you ("you," "your," or "User") and HomeSpark, Inc. ("HomeSpark," "we," "us," or "our"). These Terms govern your access to and use of our mobile application(s), website(s), software, content, and related services (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY. SECTION 23 CONTAINS A MANDATORY BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECTS YOUR LEGAL RIGHTS.
By accessing, downloading, or using the Services, you agree to be bound by these Terms and all documents incorporated by reference, including our Privacy Policy and Data Processing Addendum. If you do not agree to these Terms, you may not use the Services.
1.1 Home Scans. HomeSpark enables Users to scan their home (interior and exterior) using a compatible mobile device to create still images, sequences of "frames," and/or 2D/3D representations (collectively, "Scans").
1.2 AI Interaction. The Services include AI-powered features that allow you to provide text, images, or other materials ("Input") and receive generated answers, summaries, and other content ("AI Output").
1.3 Tools and Partner Integrations. The Services may surface internal and external tools, informational resources, products, offers, or services from HomeSpark or our Business Partners.
2.1 Age. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Services.
2.2 Authority. If you use the Services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2.3 Account Security. You are responsible for all activities that occur under your Account and for maintaining the security of your credentials. You must notify us immediately of any unauthorized use.
Key terms used throughout this document are defined herein or in the attached Data Processing Addendum ("DPA"). "User Content" means all Scans, Input, and any other data or materials you provide to the Services.
